Terms of Service

These Terms of Service ("Terms") govern your access to and use of the VibePing website, SDK, and cloud service (collectively, the "Service") operated by VibePing ("we", "us", "our").

1. Acceptance of Terms

By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree, do not use the Service.

2. Service Description

VibePing is a web analytics and monitoring platform. The Service includes:

• A JavaScript SDK for collecting pageviews, errors, web vitals, and custom events
• Dashboards for viewing analytics and performance data
• Uptime monitoring and alerting
• AI-powered insights and suggestions

The open-source core of VibePing is licensed under AGPL-3.0. The cloud service (hosted at vibeping.dev) is a proprietary offering built on top of the open-source core.

3. Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this requirement.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Abuse, interfere with, or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to other users' data
• Send excessive or automated requests designed to overload the Service
• Resell or redistribute access to the Service without permission
• Use the SDK to collect sensitive personal data (health, financial, biometric) without proper consent

We reserve the right to suspend or terminate accounts that violate these terms or abuse the Service.

5. Your Responsibilities

As a site owner using VibePing, you are responsible for:

• Obtaining any necessary consent from your end-users where applicable under your local laws
• Ensuring that custom events you send do not contain sensitive personal information unless you have proper legal basis
• Complying with all applicable privacy laws and regulations in your jurisdiction

6. Intellectual Property

The VibePing open-source SDK and core libraries are licensed under the AGPL-3.0 license. You may use, modify, and distribute them in accordance with that license.

The VibePing cloud service, branding, website content, and proprietary features are owned by VibePing and protected by intellectual property laws. You may not copy, modify, or distribute these without permission.

You retain ownership of all data you submit to the Service. We claim no intellectual property rights over your analytics data.

7. Payment Terms

VibePing offers a free tier with limited usage. Paid plans are available for higher volumes and additional features.

• Payments are processed securely via Stripe
• Paid plans are billed monthly or annually, depending on your selection
• You may cancel your subscription at any time; access continues until the end of the billing period

8. Termination

You may delete your account at any time through your account settings. Upon deletion, all your data will be permanently removed within 30 days.

We may suspend or terminate your account if you violate these Terms, abuse the Service, or engage in activity that harms other users or our infrastructure. We will make reasonable efforts to notify you before suspension, except in cases requiring immediate action.

9. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

To the maximum extent permitted by law, VibePing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

10. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.

11. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email to registered users before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service will be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
